If you have a country property in Spain, apartment or townhouse and want to rent rooms or are even thinking of building a mini rooftop apartment rooftop, we would like to give you some  guidelines to help generate income with it and start your business of renting rooms.   Easy, practical and highly profitable.

In addition to the rental room, you must assign the use of certain common areas of the house such as the bathroom, kitchen or living room, and share your home and your privacy with your tenants.  This can be quite interesting , getting to know other people including those from other countries.   

Room rent is regulated by the civil code, unlike renting a complete house, which makes it governed by the law of urban rentals (LAU). The contract between landlord and tenant is recommended to be put in writing so that no conflicts arise after the rental commences.  It must be signed by both parties and contain different points  such as:
- What is the exact room the tenant will occupy.

-The price and form of payment.

- The duration of the contract.

-  Which services are included in the rental ( kitchen usage, telephone, internet, etc) and how will additional costs be paid such as electricity, wáter, internet or satellite.

-  Whether or not the tenant can sublet the room, as, according to the civil code,  if the contract does not indicate otherwise the tenant could sublet.

-  Confirm if the owner uses the home as their habitual residence.

Kindly note that despite these general recommendations we would advise that a professional person revises the contract before signing to resolve any questions arising between the parties.  

If you would like to rent one or more rooms of the house where you live although you are not the owner, but rent the house, you must realize that firstly you it is essential to have the express permission of the owner, as to sublet without this is grounds for termination of the contract.  In addition the owner has the right to be compensated for the sublet of the property.

For taxation purposes the owner must declare on their tax return the amount they receive for the rental. The downside for the tenant is that if they  only rent one room and not the whole house is that it is not tax deductible.
